Things are not looking great for the Frye campaign, check Donna Frye For Mayor.com — a big sticking point is that there’s a new lawsuit to measure voter intent. Seems as though some of the votes are not being counted because the voters failed to fill in the black oval, and merely *wrote* out the name Donna Frye. So, Dick Murphy is ahead.

    I’m not sure about all the legal precedent set re: write-ins and voter intent, but I’d say if there’s precedent set, pursue it to the first level. If there isn’t, perhaps I’d suggest she run again later, in less arguable legal circumstances. I don’t think she’d be looked upon any more favorably if she litigated her way into office, especially only through counting the votes of the people who didn’t follow the rules.

    Statement from Councilmember Donna Frye on League of Women Voter’s Lawsuit decision:

    “First, I want to thank the League of Women Voters, my family, all of my supporters and my attorneys from Coast Law Group, especially Mr. Marco Gonzalez. I appreciate your hard work and dedication to the democratic process.

    Today, those of us who stand for the proposition that all votes cast should be counted suffered a setback. But for those of you who stood with me at a candlelight vigil only a few nights ago know that while our flame may flicker, it will never die.

    For our cause is more than a campaign about filling in bubbles — it is about giving a voice to a citizenry that calls for an end to back room deals, politics as usual, and an attitude of government arrogance and entitlement.

    In five short weeks, we accomplished what no one believed possible. We defied logic and conventional wisdom. We defeated Mr. Status and Mr. Quo. I guess you could say, ‘They got Fryed.’

    Citywide, more than 150,000 strong wrote in Donna Frye and sent a message to City Hall that they’d had enough and were not going to take it anymore. To you, my friends, I say, our time shall come. Patience is power. ”
